Online store purchase 

Billyara accepts all major cards including Visa, Mastercard, American Express and Discover credit card payments.

 

Commissions

Billyara commission pieces require a 50% deposit upon acceptance and 50% final payment prior to shipping or collection (deposit is not refundable if the order has been cancelled or not fullfilled as per terms and conditions agreed with the customer).  Payment plans are availiable when pre-negotiated with artist. Items cannot be shipped or collected until the final payment has cleared in Billyara’s account.

Returns

All sales on artworks are final and non-refundable.

 

Shipping information

All artwork shipping within normal dimensions will be quoted as per Australia Post guidelines, postage includes tracking and signature on delivery. This will automatically be applied to your shipping costs, no exceptions.

Billyara packs and labels all items with the utmost care. Any breakages or damages in transit are the responsibility of Australia Post or carrier. It is up to the customer to advise Billyara within 24 hours of receiveing an item if any damage has occured and contact Australia Post or carrier accordingly.

General delivery occurs within 5-7 working days, some locations and peak periods may take longer than expected. Once sent we provide you with a link to the item on Australia Post or carrier website. Australia Post or carrier tracking will update a packages location and while we also track the items to make sure they arrive safely, we cannot be held accountable for any delays or lost items.

 

All larger artwork and overseas delivery require a courier service, please contact us to get a quote prior to purchase.

Please note we do not send to Post Office Boxes. All delieries will require a signature on delivery at your address. If you are not home your package will be taken to your nearest Post Office and a card will be left at your premises advising collection details.

Please Note: You may be required to pay customs duty and/or port charges in the country where your artwork is delivered. Please make your own inquiries as these charges are the buyer's responsibility. 

Workshop bookings

All workshop bookings require a 50% deposit to secure the booking request. This deposit is non refundable if the booking is cancelled however, a date change may be requested up to 14 days prior to the original day/time. All requests must be sent via email to billyara_70@bigpond.com (Billyara will try accommodate any changes, however it is at the artist’s discretion to approve a change and apply credit/refund of monies paid).

Transaction Terms & Conditions

By proceeding with a transaction on this website you agree to be bound by the following terms and conditions:

1. Interpretation

1.1 In this Agreement ”Billyara’ means Brett Parker.

1.2 Customer or you means the customer placing this purchase order with Billyara.

1.3 Goods means the goods ordered by you from Billyara.

1.4 This Contract shall be governed and construed in accordance with the laws in force in the State of Queensland and the parties submit to the non-exclusive jurisdiction of the Courts of Queensland.

 

2. Obligations of Billyara

2.1 Billyara must: - (i) pending payment and subject to Clause 3 of this Agreement, deliver the goods ordered by the customer to the customer’s delivery address within a reasonable time;
(ii) ensure the goods are free from defects when packing and that the goods perform their intended function.

2.2 A failure by Brillyara to perform those obligations mentioned in Clause 2.1 of this Contract does not give the customer a right or cause of action at law against Brett Parker or a right to terminate this Contract.

 

3. Your Obligations

3.1 It is a condition of this Agreement that payment be made by you in respect of goods ordered from Billyara and proper payment details provided by you before proceeding with this transaction.

3.2 You acknowledge that Billyara reserves the right to refuse any order where it is apparent to Billyara that payment details provided by you are incorrect, improper or the subject of fraud.

3.3 You acknowledge payment is a condition precedent to shipment and Billyara reserves the right to refuse any order where it is apparent that payment of goods ordered by you cannot or is unable be processed.

3.4 Notwithstanding Clauses 3.1, 3.2 & 3.3 Billyara reserves the right to render tax invoice/s in respect of goods ordered by you in circumstances it so chooses and you hereby agree to pay any tax invoice rendered by Billyara by the due date for payment specified on the tax invoice.

3.5 If any tax invoice is not paid by the due date for payment Billyara shall be entitled to charge interest on such amount as is outstanding from time to time at the rate of 1.5% per month.

3.6 Notwithstanding Clauses 3.4 & 3.5 the customer acknowledges it will remain liable to Billyara for the total price of the goods whether or not the goods have been shipped, delivered or a tax invoice rendered in respect of the goods so ordered.

 

4. Shipping and Delivery Policy

4.1 We deliver products Australia wide through companies such as Australia Post, Pack and Send and TNT Couriers.

4.2 Orders are dispatched as soon as payment is cleared.

4.3 Exact shipping costs are calculated in the shopping cart and will be added to the order total before checkout.

4.4 Billyara ships goods Worldwide. For international orders (outside Australia) please email prior to any purchases on the website for delivery costs.

 

5. Pricing Policy

5.1 All of our prices are in Australian dollars (AUD).

5.2 Product prices are regularly updated.

 

6. Privacy policy

6.1 Billyara is dedicated to keeping your details private. Any information we collect in relation to you is kept strictly secured.

6.2 We do not pass on, sell or swap any of your personal details with anyone. We use this information to identify your orders, provide you with newsletters and to personalise your shopping experience with us.

 

7. Security Policy

7.1 When purchasing from Billyara your financial details are passed through Shopify? Payments using the latest encryption technology. If you have any questions, please contact us.

We collect such personal information as name, phone numbers, physical and/or email addresses and dates of engagement between you and billyara.com.  When it is provided for the purpose of payment for services of any kind, some financial information is retained for processing the payment and as a record or receipt of payments made, such as would be found on our bank statements and computer systems.  Financial information is not stored anywhere else and is not collected for any other reason. 

This information is used:
    • To enable us to maintain client contact details.

    • To enable a copy of the cherneesutton.com.au newsletter to be mailed to you monthly, via email if you have registered and opted-in for this service through our website.

    • To maintain records related to your online experience in the form of client feedback including compliments, complaints and survey responses. We use our secure system to also track activity on managing any complaints or queries from our clients.

    • There may also be occasion for us to mail, email or phone you regarding individual inquiries, requests, or other relevant communication.
